Splošni pogoji poslovanja določajo uporabo spletne trgovine ArtDanaja (v nadaljevanju: Spletna trgovina), ki jo upravlja podjetje ARTDANAJA Danaja Padovac s.p.., Šalka vas 63, 1330 Kočevje (v nadaljevanju: Ponudnik) in je dostopna na spletni strani www.artdanaja.si (v nadaljnjem besedilu: Spletna stran)
These terms and conditions have been drawn up in accordance with the Consumer Protection Act (hereinafter referred to as: ZVPot), based on the recommendations of the Chamber of Commerce and Industry and international codes for electronic commerce. The General Terms and Conditions address the operation of the online store, the rights of the buyer and the business relationship between the buyer and the seller or the online store operator.
Prices in the online store are indicated in euros. VAT is not charged based on paragraph 1 of Article 94 of the Value Added Tax Act.
Prices are valid at the time of placing the order and have no predetermined validity. Prices are valid in the case of payment using the published possible payment methods.
Ordering is possible 24 hours a day, 7 days a week, 365 days a year. The sales contract between the Provider and the buyer is concluded at the moment when the Online Store sends the first email confirming the buyer's order.
The buyer on the Website selects products in the store tab. By clicking on the "add to cart" button, the buyer selects the desired product, which is then visible in the cart. If the buyer wants to change an ordered item that is already in the cart, he can remove the selected item from the cart by clicking on the red button. The buyer continues with the purchase by clicking on the "proceed to checkout" button, where he enters his personal information, selects a payment option and places the order by clicking on the "buy now" button.
After completing the order, the buyer receives a confirmation email with information about the selected order.

The delivery partner is Pošta Slovenije, but the Provider reserves the right to choose another delivery service in case of more efficient order fulfillment. The delivery amount depends on the payment method and the purchase amount, which is visible when purchasing each product.

Darilne bone je možno naročiti na elektronski naslov www.artdanaja.si in jih je možno uveljavljati tako v Spletni trgovini kot pri ostalih oblikah poslovanja s Ponudnikom. Kupec lahko naroči darilni bon v znesku po svoji želji, pri čemer so zneski na darilnih bonih vedno zaokroženi (10, 20, 30, 40 EUR, ipd.).
Gift vouchers cannot be exchanged for cash. The Provider does not refund money for purchases below the amount written on the voucher. For higher amounts, the buyer can pay the difference. Gift vouchers have no time limit and can be redeemed for any set of products, including custom-made products.
The Provider on the Website also offers the option of making custom-made artworks, whereby each such agreement is handled individually and is a matter of a special agreement between the Provider and the Website user, and they cannot be ordered in the online store.
Za delavnice, izobraževanja in druge dogodke, organizirane s strani ponudnika, vračilo že vplačanih sredstev ni mogoče.
Vračilo vplačanih sredstev je možno izključno v primeru, da je delavnica ali dogodek odpovedan s strani ponudnika. V takem primeru se udeležencu povrne celoten znesek vplačila.
Z izvedbo plačila se šteje, da se udeleženec strinja s predmetnimi pogoji in se zaveda, da odstop od udeležbe ne predstavlja razloga za vračilo sredstev.
In accordance with the provisions of Article 43 of the ZvPot, the buyer has the right to notify the Provider within 14 days of receipt of the goods that he withdraws from the contract, without having to state the reason for his decision. The goods must be returned to the Provider no later than the deadline for submitting the notification of withdrawal from the contract.
The only cost borne by the buyer in connection with the withdrawal from the contract is the direct cost of returning the goods.
The buyer must return the received goods undamaged and in the same quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of their own. The goods may not be used freely until withdrawal from the contract, but only due to the nature of the online store (distance contract) has the opportunity to reconsider the purchase. The buyer may only inspect the product and perform the test that is absolutely necessary to determine the actual condition.
The buyer does not have the right to withdraw from the contract in contracts whose subject matter is goods that were manufactured according to the consumer's precise instructions, that were adapted to his personal needs, or that are not suitable for return due to their nature.
Če se dostavljeni izdelki razlikujejo od naročenih izdelkov ali so bili dostavljeni izdelki, ki niso bili predmet naročila, lahko kupec obvesti Ponudnika na e-naslov artdanaja@gmail.com ter v skladu z dogovorom vrne dostavljene izdelke. Ponudnik bo omenjene izdelke, v primeru priznane reklamacije, brezplačno nadomestil z ustreznimi.
The Provider is not liable for the use of the online store and for any damage caused by the use of the online content located there. The Provider makes every effort to ensure the accuracy and correctness of the data in the Online Store, but due to the specifics of the online store's operations, the characteristics of the items, delivery or price may change in such a short time that the data on the website cannot be corrected. In such a case, the Provider will inform the buyer of the changes and allow him to withdraw from the order or find an amicable solution.
Although the provider strives to provide accurate images of the products for sale, all images should be taken as symbolic and do not guarantee the properties of the product.
The Website is the property of the Provider and with it all content, logos, photographs and other audiovisual and textual works. All of the aforementioned elements are therefore the subject of intellectual property, which the Provider has the sole right to dispose of. Any reproduction or other use of any element of the Website or for any other purpose, including commercial use, or for third parties, is prohibited without the prior written consent of the Provider.
The provider reserves the right to make daily changes to the content, errors in prices and written text. By using the online store, the buyer confirms that he accepts and agrees to the described terms and conditions.
The provider undertakes to protect all private data of the buyer in accordance with the provisions of the Personal Data Protection Act (hereinafter referred to as: ZVOP-1). All personal data of the online store user is confidential and will not be disclosed to unauthorized persons under any circumstances.
To make a purchase in the online store, it is necessary to collect some personal data from customers. The data that will be provided will not be passed on to third parties, except for the purpose of confirming the validity of the purchase and delivery of products. The provider takes all necessary measures to protect the confidentiality of personal data in accordance with ZVOP-1.
By purchasing in the Online Store, the buyer expressly agrees that the Provider will store and use the personal data provided when ordering (name, surname, address, e-mail address, telephone number) exclusively for the purpose of fulfilling the order.
The provider is committed to maximum care for the privacy of all data, but nevertheless warns that misuse is possible. The user or buyer is also responsible for protecting personal data, namely by ensuring the security of their username and password and appropriate software (antivirus) protection of their computer.
The provider respects the applicable consumer protection legislation and makes every effort to fulfill its duty to establish an effective complaint handling system. The complaint is submitted via e-mail address www.artdanaja.si, the complaint handling procedure is confidential. The provider makes every effort to resolve any disputes amicably.
In accordance with legal norms, the Provider does not recognize any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute that a consumer could initiate in accordance with the Out-of-Court Consumer Dispute Resolution Act (hereinafter: ZlsRPS). The Provider publishes on its website an electronic link to the platform for online consumer dispute resolution (SRPS), which is available to consumers (http://ec.europa.eu/odr)
